Information Note on the Communique on the Procedures and Principles for Transferring Personal Data Abroad and Standard Contracts and Binding Corporate Rules Documents

Following the amendment made in Article 9 of the Personal Data Protection Law:

— The draft Communique on the Procedures and Principles for Transferring Personal Data Abroad ("Communique") was published on the Personal Data Protection Authority’s ("Turkish DPA") website on 09.05.2024 and opened until to public opinion until 20.05.2024,

— Standard Contracts (“SC”) and Binding Corporate Rules (“BCR”) draft documents were published on the Turkish DPA’s website on 17.05.2024 and opened to public opinion until 27.05.2024.

Final versions of the above draft documents have been published as of today.

The Communique entered into force by being published in the Official Gazette numbered 32598 and dated 10.07.2024. In addition, the Turkish DPA published the documents regarding SC and BCR on its official website as of the same date.

These documents were accepted by the decision of the Personal Data Protection Board dated 04.06.2024 and numbered 2024/959. These documents include: SC texts, BCR application forms and BCR guidelines.
