Begüm Yavuzdoğan Okumuş has been with Gün + Partners since 2007 and became a partner in 2021. Her practice focuses on data protection and privacy, corporate and M&A, life sciences, and competition.

Begüm deals with all aspects of data protection and privacy, including supervising and conducting data privacy compliance projects and advising multinational clients in their activities on a day-to-day basis as well as in their specific projects. She has sector-specific knowledge in regulated sectors and advises clients on newly developed devices/apps to ensure compliance. Begüm advises clients on international data transfer of personal data and represents clients before the Turkish DPA. She assists clients in data breach notifications and investigations and provides appeal strategies to object to Turkish DPA decisions rendered against our clients. Begüm represents multinational companies operating in various industries including pharmaceutical, medical device, telecoms, banking and automotive industry. She holds Certified Information Privacy Professional Europe (CIPP/E) designation from the International Association of Privacy Professionals and she is one of the former co-chairs of the IAPP Knowledgenet Istanbul Chapter and a founding member of the Data Protection Association in Istanbul.

Begüm led several M&A projects including due diligence processes and assisted various local and foreign companies during the incorporation of their partnership in special projects which also include the transfer of technology, and know-how and thus needs protection in this respect. She drafted and negotiated several joint-venture agreements, shareholder agreements, share pledges, and voting agreements. In addition to her corporate law expertise, she has experience in competition law-related matters and provides full service to clients in their corporate law-related matters. Apart from providing consultancy services and trainings, she is also representing clients before the TCA about notifications and investigations.

Having wide range of experience in the pharmaceutical and medical device industry, Begum advised and represented several multinational pharmaceutical and medical device companies on their commercial deals and needs, including advising on their new investments in Turkey, marketing authorization and asset transfers, corporate restructuring projects, negotiating distributorship agreements and termination of these agreements, and advising on localization projects.

Turizm Amacıyla Konutların Kiralanmasına İlişkin Gelişmeler

7464 sayılı Konutların Turizm Amaçlı Kiralanmasına ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun (“Kanun”), 2 Kasım 2023 tarihinde Resmi Gazete’de yayınlanmıştır. Kanun konutların en fazla 100 gün süreyle kiralanmasına ilişkin şartları ve konutları turizm amacıyla kira verenlerin yükümlülüklerini detaylı şekilde düzenlemekte olup ilgili düzenlemeler 1 Ocak 2024 tarihinde yürürlüğe girecektir. Kanun koyucu tarafından son yıllarda dünyada ve ülkemizde ikincil konutların kısa süreli olarak kiralanması suretiyle turistik konutun yaygınlaşması ve bu hizmetlerin turizm sektöründe yeni bir alt kol haline geldiğini gözeterek turizm sektörünün tek elden ve kapsayıcı bir stratejiyle geliştirilmesi amacıyla konuyu düzenleme ihtiyacı duymuştur. Bu çerçevede, turizm amaçlı kiralanan konutların belgelendirilmesi, bunlardan elde edilen gelirlerin kayıt alınması, kayıt dışı kazancın engellenmesi, konutlarda kalacak kişilerin suç işlemesinin önüne geçilmesi için kimlik bildirme yükümlülüğünün uygulanabilmesi ve eşit bir rekabet ortamı yaratarak turizm sektöründeki tüm paydaşlara güvenilir bir yatırım ortamının oluşturulması hedeflenmektedir.

Developments Regarding the Renting of Residential Places for Tourism Purposes

The Law No. 7464 on the Renting of Residential Places for Tourism Purposes and Amendments to Certain Laws (the "Law") was published in the Official Gazette on November 2, 2023. The Law regulates in detail the conditions for renting residential places up to 100 days and the obligations of those who rent their premises for short terms for tourism purposes. The relevant provisions of the Law will come into force on January 1, 2024.

Authorization Obligation is on the Horizon for OTT Services

Turkey's "disinformation law" has come into force, making all over-the-network (OTT) service providers subject to regulations that include an authorisation obligation. Under the law, OTT service providers must apply to the Information and Communication Technologies Authority (BTK) for authorisation through a fully authorised representative, which must be a joint stock company or limited liability company in Turkey. Other regulations that may apply include obligations on consumer rights, personal data protection and service quality, as well as reporting and financial obligations. Fines for non-compliance range from TRY 1m to TRY 30m, and non-payment could lead to bandwidth reduction or blocking of access to the relevant application or website.
