    Lawyers Yağmur Yollu

    Yağmur obtained her law degree as a high honor student and pursued her master’s degree (LL.M.) on commercial law and information law in Istanbul University Law School. During her master's degree, she completed her thesis on “Protection of Websites” – which is the first academic study in Turkey that approaches the protection of websites in the scope of intellectual property law.

    Yağmur’s main areas of expertise are internet and technology law, electronic commerce law, data security law, and media and entertainment law. She has advanced her academic and professional career on information technology law and in the digital world.

    Yağmur is the senior associate of Gökçe’s TMC & Privacy team. She is also one of the authors of the first book on e-sports law in Turkey.

    During her career, Yağmur has represented many technology-oriented national and multi-national companies and taken part in projects on everyone’s radar. She has worked in joint projects with several foreign law firms such as DLA Piper, K&L Gates, Fieldfisher LLP, Osborne Clarke, and Bristows and has been a team leader in international data protection compliance projects.

    Since 2016 January, she has been working as an associate of TMC & Privacy team.

    AYM’s Decision Affecting the Provision of Geographic Data License

    The Constitutional Court (AYM) issued a decision on case no E.2020/42 K.2023/99, which was filed for the annulment of some of the provisions in Law No. 7221 on Making Amendments in Geographical Information Systems and Some Laws (Law), on 18 May 2023. The decision was published in the Official Gazette on 4 October 2023.

    Critical Changes from TCMB for Payment and Electronic Money Institutions

    Central Bank of the Republic of Turkey (TCMB) published the “Regulation Amending the Regulation on Payment Services and Electronic Money Issuance and Payment Service Providers” and the “Communiqué Amending the Communiqué on Information Systems of Payment and Electronic Money Institutions and Data Sharing Services of Payment Service Providers in the Field of Payment Services” in the Official Gazette dated 7 October 2023.

    Remote Identification Made Feasible for Fintechs

    Bilgi Teknolojileri ve İletişim Kurumu (BTK), elektronik haberleşme hizmeti almak isteyen tüketicilere eksik, hatalı ve yanıltıcı bilgiler verilerek tüketicilerin mağdur edilmesini engellemek amacıyla, yeni aboneliklere yönelik düzenleme getirdi. Bu kapsamda; 13.09.2023’te “İnternet/TV ve Sabit Telefon Hizmetlerine İlişkin Bireysel Yeni Abonelik Tesisi Öncesinde Teyit İşlemleri Yapılması Hakkında Usul ve Esaslar” (Karar) BTK’nın resmi sitesinde yayımlandı.

    Ministry of Treasury and Finance’s Authority to Block Access is Revoked

    Law No. 7194 on Digital Service Tax and Amendments to Certain Laws and Decree Law No. 375 (Law) introduced new taxes such as digital service tax, accommodation tax, and luxury housing tax. The Constitutional Court (Court) found certain provisions of the Law related to their taxes unconstitutional in its decision E: 2020/11, K: 2023/98 dated 18 May 2023 (Decision) following an application to the Court.

    Significant Legislative Amendments for Immovable Property and Secondhand Motor Vehicle Websites

    The Ministry of Trade introduced significant amendments regarding the sale of immovable property and second-hand motor vehicles. Accordingly, the “Regulation Amending the Regulation on the Trade of Immovable Property” and the “Regulation Amending the Regulation on the Trade of Second-Hand Motor Land Vehicles” (Amendment Regulations) were published in the Official Gazette dated 31.08.2023. These amendments, which affect multiple laws, particularly the Protection of Personal Data and the Law on the Regulation of Electronic Commerce, are in parallel.

    Decision from BTK: Confirmation Obligation for Internet/TV and Landline Phone Subscriptions

    The Information and Communication Technologies Authority (BTK) has introduced a regulation on new subscriptions in order to prevent consumers from being harmed by providing incomplete, incorrect and misleading information to consumers who intend to receive electronic communication services. In this context, the “Procedures and Principles on Confirmation Procedures Prior to the Establishment of New Individual Subscriptions for Internet/TV and Fixed Telephone Services” (Decision) was published on the official website of the BTK dated 13.09.2023.

    Günümüzde dijitalleşme ve teknolojideki atılımlar özellikle tüketiciler açısından önemli hukuki sorunlar oluşturuyor.     Sağlık Hizmetlerinde Reklam ve Tanıtım Faaliyetlerine İlişkin Yeni Düzenlemeler

    Sağlık Bakanlığı (Bakanlık) tarafından hazırlanan Sağlık Hizmetlerinde Tanıtım ve Bilgilendirme Faaliyetleri Hakkında Yönetmelik (Yönetmelik), 29 Temmuz’da Resmî Gazete’de yayımlandı. Yönetmeliğin temel amacı; sağlık hizmetlerinde tanıtım ve bilgilendirme faaliyetlerine ilişkin temel ilke ve ölçütleri belirlemek. Yönetmelik, bu faaliyetlerin denetlenmesi ve uygulanacak yaptırımlara ilişkin usul ve esasları da düzenliyor. Yönetmeliğin temel olarak getirdiklerini aşağıda özetledik.

    E-Signature Era in Google Drive and Google Documents

    Google has announced the open beta version of the e-signature feature in Google Workspace. The feature allows users to request signatures or initials from recipients in Docs and Drive, and the signature date section can be automatically filled in. Google also offers the ability to check whether the requested signatures have been received. E-signatures are becoming increasingly common in digital transactions, as they offer a secure and convenient way to sign documents electronically. Google's e-signature feature is expected to be a valuable addition to Google Workspace, and it remains to be seen how the company will comply with e-signature legislation both in Türkiye and globally.

    Digital Banks are Coming

    The Banking Regulation and Supervision Agency (BRSA) has authorized the establishment of a digital deposit bank in Turkey. The bank, called Colendi Bank, will have a capital of 2 billion Turkish liras and will operate entirely through electronic channels. The BRSA's decision is a sign of the growing importance of digital banking in Turkey.

    New Provisions on Advertising and Promotion Activities in Healthcare Services

    The Turkish Ministry of Health has published a new regulation on promotional and informative activities in healthcare services. The regulation prohibits "covert or overt advertising" in healthcare services and requires that promotional and informative activities be conducted in compliance with certain principles. The regulation also imposes sanctions for violations.

    MASAK, Tüzel Kişilere Uzaktan Kimlik Tespiti Yapılabilmesi için Gerekli Yasal Düzenlemeyi Gerçekleştirdi

    Geçtiğimiz günlerde bankaların tüzel kişilerin uzaktan kimlik tespitini gerçekleştirmesi Bankalarca Kullanılacak Uzaktan Kimlik Tespiti Yöntemlerine ve Elektronik Ortamda Sözleşme İlişkisinin Kurulmasına İlişkin Yönetmelik’te Değişiklik Yapılmasına Dair Yönetmelik ile mümkün kılınmıştı, detaylarını bu yazımızda bulabilirsiniz. 1 Haziran 2023’te yürürlüğe giren ilgili düzenleme uyarınca tüzel kişilerin uzaktan kimlik tespiti yöntemiyle banka müşterisi olabilmesi mümkün olsa da Mali Suçları Araştırma Kurulu (MASAK) mevzuatı anlamında bu konu henüz düzenlenmemişti ve tüzel kişilerin bu yöntemle müşteri olması MASAK düzenlemelerine uygun değildi. Nitekim bankalar, MASAK mevzuatına da uymakla yükümlü olduklarından, uzaktan kimlik tespitine dair MASAK Sıra No:19 Genel Tebliği’ndeki “müşteri” tanımının tüzel kişileri kapsayacak şekilde düzenlenmesi gerekiyordu.

    MASAK Made the Required Legal Amendments for Remote Identification of Legal Entities

    As known, remote identification of legal entities by banks was made feasible by the Regulation Amending the Regulation on Remote Identification Methods to be Used by Banks and Establishment of the Contractual Relationship in Electronic Environment. In accordance with the relevant regulation, which entered into force on 1 June 2023, although it was feasible for legal entities to become bank customers through remote identification, this was not yet feasible in terms of the Financial Crimes Investigation Board (MASAK) legislation. In fact, since banks are also obliged to comply with the MASAK legislation, the definition of "customer" in the MASAK General Communiqué No. 19 on remote identification had to be amended to include legal entities.

    Fintek Ekosisteminde Güncel Gelişmeler

    Fintechler finans sektöründe önemini artırıyor. Türk otoritelerinin yakından izlediği bu gelişmeler Türkiye Merkez Bankası'nı (TCMB) harekete geçirdi. TCMB, ödeme ve elektronik para kuruluşlarının düzenlemelerine uyum tarihini değiştirdi. 29 Nisan 2023'te yapılan değişiklikle ödeme ve elektronik para kuruluşlarının 30 Haziran 2023'e kadar yerine getirmesi gereken yükümlülükleri düzenlendi. Geçici 1. maddede yapılan değişiklikle bazı yükümlülüklerin uyumluluk süresi 30 Eylül 2023'e uzatıldı. Değişiklikle, ödeme sistemleri ve hizmet sağlayıcılarının belirli maddelere uyumlu hale gelmesi gerekiyor.

    Current Developments in the Fintech Ecosystem

    The growing role of Fintechs in the finance sector led Turkey's Central Bank to amend compliance deadlines for payment and electronic money institutions. In line with the 29 April 2023 regulation, obligations must be met by these institutions by 30 June 2023. However, an amendment to the regulation occurred on 27 June 2023, extending the compliance period to 30 September 2023. These obligations encompass various requirements for payment systems, service providers, and data sharing. Notably, specific provisions apply to payment service providers with payment accounts since 1 December 2021, prioritizing connectivity and infrastructure.
