    he Competition Board (“Board”) announced on its website that the investigation initiated against Krea İçerik Hizmetleri ve Prodüksiyon AŞ (“Krea”) was concluded with a commitment procedure1. Almost a year ago, the Board had initiated an investigation against Krea, the exclusive holder of the broadcasting rights for Turkish Super League and Turkish First League football matches, abused its dominant position as per Law No. 4054 on the Protection of Competition (“Competition Law”) by discriminatorily o ering sub-broadcasting rights, including “news-related footage” and “full highlights,” to other broadcasting companies under the scope of broadcasting rights.

    Trabzon 2. Asliye Ceza Mahkemesi, görmekte olduğu bir davada 5271 sayılı Ceza Muhakemesi Kanunu’nun (“CMK”) 273/1. maddesinde mezkûr “hükmün açıklanmasından itibaren” istinaf kanun yoluna başvuru zorunluluğu öngören hükmün Anayasa’nın 13 (Temel hak ve hürriyetlerin sınırlanması), 36 (Hak arama hürriyeti) ve 141. (Duruşmaların açık ve kararların gerekçeli olması) maddelerine aykırı olduğu gerekçesi ile iptali için Anayasa Mahkemesi’ne itiraz yoluna başvurmuştur.

    Short Petitions for Appeal Will Be History

    The Trabzon 2nd Criminal Court of First Instance applied to the Constitutional Court (contention of unconstitutionality) to annul the sentence under Article 273/1 of the Code of Criminal Procedure No. 5271 ("CCP") stipulating that a motion for appeal must be submitted "as of the pronouncement of the verdict", on grounds that it is in violation of Articles 13 (Restriction of fundamental rights and freedoms), Article 36 (Right to legal remedies) and Article 141 (Publicity of hearings and the necessity for the justification of verdicts) of the Constitution.

    Commitments in Turkish Competition Law and Claim for Damages

    The commitment procedure is an increasingly popular tool used in competition law that serves procedural economy by bringing closure to preliminary inquiries and investigation proceedings (“assessment proceedings”) while diminishing competition issues before they become competition infringements. The use of the term “competition issues” rather than “competition infringements” is significant for the commitment procedure as it allows undertakings to make amendments for potential anti-competitive behavior that does not constitute a hard-core infringement of competition.

    The Turkish Competition Board (“Board”) announced that Meta Platforms, Inc., Meta Ireland Limited, WhatsApp LLC (all referred to as “Meta”), and Madoka Turkey Bilişim Hizmetleri Ltd. Şti. (“Madoka”) must pay administrative fines for violating Article 6 of Law No. 4054 on the Protection of Competition (“Competition Law”) with the decision published on 26.10.2022. As discussed in our November bulletin, the expected reasoned decision was published on 11.09.2023.

    Hergüner Aylık Rekabet Bülteni - Ağustos 2023

    Rekabet Kurulu (“Kurul”), 2021 yılında farklı sektörlerden önde gelen birtakım teşebbüsler hakkında işgücü piyasasında rekabeti olumsuz etkileyecek şekilde centilmenlik anlaşmaları yaptıkları gerekçesiyle soruşturma başlatmıştı. Rekabet Kurumu’nun sitesinde 02.08.2023 tarihinde yayımlanan nihai kararla[1] ise bu soruşturma sonuçlandırılmış ve hakkında soruşturma yürütülen 48 teşebbüsten 16’sı hakkında toplamda yaklaşık 151 milyon TL idari para cezası verilmesine karar verilmiştir.

    According to the Petroleum Market Law and the Natural Gas Market Law, a licence is required in order to perform market activities regulated under such legislation. Licence applications are made to EMRA. Licensees are entitled to benefit from the expropriation process if required by the licensed activities.     In 2021, the Turkish Competition Board (“Board”) initiated an investigation of certain leading undertakings, varying across different sectors, for entering into gentleman’s agreements in the labor market in a way that adversely affects competition in the relevant market. The investigation was concluded with the final decision  published on the Turkish Competition Authority (“TCA”)’s website on 02.08.2023, and a total administrative fine of approximately TRY 151 million was imposed on 16 of the 48 undertakings party to the investigation.

    Marka Davalarında Google Ads Şifrelerine Yeni Yaklaşım

    Son dönemde Google, Bing, Yahoo, Yandex, Baidu vb. gibi arama motorları üzerinden verilen çevrimiçi reklamlar, şirketlerin önemli bir tanıtım aracı haline gelmiş durumda[1]. Arama motoru reklamcılığı veya anahtar kelime reklamcılığı olarak bilinen bu reklam türünde, şirketler, arama motorlarının reklam sitelerinde (Google Ads[2], Bing Ads, Yahoo Advertising vb.) oluşturdukları hesap üzerinden giriş yaparak özelleştirilmiş reklamlar veriyorlar. Söz konusu özelleştirme, belirli anahtar kelimeler seçilerek (bkz. anahtar kelime eşleme) yapılıyor[3]. Bu anahtar kelimeler "ayakkabı", "şapka", "spor", "voleybol topu" vb. gibi jenerik kelimeler veya kelime öbekleri olabileceği gibi, farklı markalar ile bağdaşabilecek kelimeler hatta üçüncü kişilere ait tescilli markalar da olabiliyor[4].

    Energy: Oil & Gas 2023 - Part 1

    Under the Turkish Petroleum Law No 6491, the term “petroleum” includes crude oil and natural gas. Petroleum resources in Türkiye are owned by, and are at the disposal of, the state. However, upstream interests are granted by way of licences with definite terms. In such cases, exploration licence and production lease holders must pay the state a one-eighth share (12.5%) as royalty for petroleum produced from an exploration or production area.
