Saudi Civil Transactions Law

The Civil Transactions Law (“the CTL”) of Kingdom of Saudi Arabia has been issued on 18 June 2023 with the Royal Decree M/191 and published on 19 June 2023 in the Official Gazette. In accordance with the Article 721 of the CTL, the CTL will come into effect 180 days after its publication in the Official Gazette, which corresponds to 16 December 2023.

Akıncı İnşaat Bülteni - Temmuz 2023

İnşaat sektöründe karbon emisyonlarının azaltılması çalışmalarıyla birlikte, deniz üstü rüzgâr çiftliklerinin inşası için FIDIC sözleşmeleri sıklıkla kullanılmaktadır. Bu projelerin özel ihtiyaçlarına cevap verebilmek amacıyla FIDIC, deniz üstü rüzgâr çiftliği projelerine yönelik yeni bir sözleşme hazırlamak üzere bir komisyon görevlendirmiştir. Bu çalışmalar sonucunda, 2025'in sonlarına doğru yeni sözleşmenin tamamlanması planlanmaktadır. Aynı dönemde Türk müteahhitler, yurt dışında 110 projeyi üstlenerek 7 milyar 498 milyon 146 bin dolarlık iş hacmi elde etmiştir. Rusya, Türkmenistan ve Irak, müteahhitlerin en çok projeyi üstlendiği ülkeler arasında yer almaktadır.

Planlı Alanlar İmar Yönetmeliğinde Değişiklik Yapılmasına Dair Yönetmelik, Çevre, Şehircilik ve İklim Değişikliği Bakanlığı tarafından 12 Mayıs 2023 tarihinde Resmî Gazete’de yayımlandı. 1 Temmuz’dan itibaren yürürlüğe girecek yönetmelik uyarınca konut niteliğindeki yapılarda ticari zemin kat yüksekliği 4,5 metreyi aşamayacak, kısa kolonlar oluşturulamayacak, güvenlik sebebiyle asma katlar ve 4 kat ve üzeri yapılarda kapalı çıkma yapılamayacak.

Evolution of the Contractor’s Claim Notice Provisions In FIDIC Contracts – 1999 vs. 2017

The Contractor's Claim Notices are essential for contract management and dispute resolution in FIDIC contracts. They establish a party's entitlement, provide evidence of the event(s) giving rise to the claim, and impose an obligation on the Employer to address the situation. Claims for additional payment and extension of Time for Completion are typically subject to notice requirements. The format and content of the Contractor's Claim Notice vary between FIDIC 1999 and FIDIC 2017, with the latter imposing stricter requirements. The notice must describe the event, indicate the intention to claim, be in writing, and follow the specified communication method. Timing is crucial, as the notice should be submitted within 28 days of awareness. Failure to comply may result in loss of entitlement. The subsequent steps in the dispute resolution process involve submitting particulars of the claim, consulting with the Engineer/Employer, dispute board referral, notice of dissatisfaction, amicable settlement discussion, and arbitration. Parties must adhere to these steps, as non-compliance may forfeit their right to pursue or challenge a claim.

16 Mart 2023 tarihinde Resmi Gazetede yayınlanan tebliğle inşaatta kullanılacak demirlerin üretim ve ithalat aşamalarından yapı müteahhidine teslim edilmesine kadar tüm aşamalarının takibine yönelik usul ve esaslar belirlendi. Tebliğ kapsamında inşaat demirinin tüm aşamalarda takip edilmesini sağlamak için Darphane tarafından İnşaat Demiri İzleme Sistemi (İDİS) kurulacak, inşaat demiri üretimi veya ithalatı yapan firmalar inşaat demirine güvenlikli etiket ve/veya güvenlik işareti koyacak, firmalar için İDİS bileşenleri tahsis edilecek ve sistem paydaşları Darphane’nin sitesinde yayınlanacak kılavuzda belirlenen usul ve esaslar çerçevesinde, kurulacak denetim sistemine ilişkin verileri Darphane ile paylaşacak.

Türkiye İstatistik Kurumu'nun (TÜİK) açıklamasına göre, inşaat sektörü cirosu geçtiğimiz yıla göre %124 arttı ve bina dışı yapı inşaatlarında %123, özel inşaat faaliyetlerinde %140 artış gözlemlendi. FIDIC, inşaat sektöründe yolsuzlukla mücadele konulu bir konferans düzenledi ve yolsuzluğa dair bir rapor yayınladı. Ayrıca, Yargıtay 6. Hukuk Dairesi, işverence aksi ispat edilmedikçe inşaatın yüklenici tarafından tamamlandığını kabul ettiği kararını verdi.
