    The Regulation on Clinical Trials of New Medicinal Products for Human Use Was Published

    A new regulation on clinical trials in Turkey has been published in the Official Gazette. The regulation aims to protect the rights of volunteers and ensure that clinical trials are conducted in accordance with international standards. The regulation abolishes the separation of duties determined according to the threshold of the disputable amount. This means that the amount in question will no longer have an effect on the determination of the arbitral tribunal. The regulation also includes provisions on the import of research products, insurance for volunteers, and the Agency's inspection powers.

    The Decision of Turkish Constitutional Court Regarding the Amendments to Law No. 4054 on the Protection of Competition

    The Turkish Constitutional Court (TCC) has made a significant decision regarding the amendments to the Law No. 4054 on the Protection of Competition through the Law No. 7246. The decision provides insights into the balance between the constitutional rights granted to undertakings and the obligations imposed on the Turkish Competition Authority. The TCC evaluated the annulment request filed by deputies under three categories: amendment of Article 9 regarding structural remedies, amendment of Article 15 concerning on-site inspections, and amendments regarding the status and appointment of Authority personnel. The TCC ruled that the amendments related to structural remedies and on-site inspections were in line with the principles of legality, legitimate purpose, and proportionality. However, the amendments regarding personnel status and appointment were annulled for being incompatible with the Constitution. This decision establishes a balance between regulatory powers and fundamental rights, leaving room for potential scrutiny of future laws and amendments.

    The European Commission has published its Report on the Protection and Enforcement of Intellectual Property Rights in Third Countries for the Year 2023

    The EU Commission published the 2023 Report on the Protection and Enforcement of Intellectual Property Rights in Third Countries. The report categorizes countries based on their IP rights protection. Turkey remains in the second category with serious systemic problems in IP protection. Turkey is mentioned as a source country for counterfeits and a transit hub from China to Europe. Concerns include inconsistent practices against transit goods, limited ex-officio actions, and ineffective enforcement against online piracy. The report highlights progress in trademark protection but raises concerns about trademark processes, copyright law, and privacy protection. The EU Commission plans to address these issues through workshops and working group meetings.

These plans grant employees the opportunity to become shareholders or gain share benefits based on set conditions. ESOPs have gained traction in Turkey, benefiting both companies and employees.     Procedures On Workplace Permits of Electric Vehicle Charging Stations Has Been Updated

    The Amendment Regulation, effective from July 29, 2023, brings changes to Workplace Opening and Operating Permits for electric vehicle charging stations. It categorizes stations into self-contained and workplace/collective building stations. Self-contained stations need a Workplace Permit and can have additional facilities. Other stations no longer require a Workplace Permit but need a "Site Selection and Activity Permit Certificate". The fee is based on area and is capped. The deadline for existing operations to comply is extended to July 31, 2024. The changes are reflected in the Charging Service Regulation.

    İş yeri Açma ve Çalışma Ruhsatlarına İlişkin Yönetmelikte Değişiklik Yapılmasına Dair Yönetmelik (“Değişiklik Yönetmeliği”) 29 Temmuz 2023 tarihli ve 32263 sayılı Resmî Gazete’de yayımlandı. Böylelikle, İş yeri Açma ve Çalışma Ruhsatlarına İlişkin Yönetmelik’te (“Yönetmelik”) elektrikli araç şarj istasyonlarını yakından ilgilendiren değişiklikler yapıldı. Ayrıca, 9 Ağustos 2023 tarihli ve 32274 sayılı Resmî Gazete’de Şarj Hizmeti Yönetmeliğinde Değişiklik Yapılmasına Dair Yönetmelik yayımlandı. Böylece, Değişiklik Yönetmelik’i ile gelen değişiklikler, Şarj Hizmeti Yönetmeliği’ne de yansıtılmış oldu.

    The Regulation on Market Control of Human Medicinal Products Entered Into Force

    The Regulation focuses on market control for licensed medicinal products, active substances, and special medical purpose foods, excluding magistral medicines. Periodic market control activities will be organized based on risk parameters set by the Agency. Samples will be taken from products' locations and active substance production sites. The Regulation outlines responsibilities for sample acceptance and examination. Complaints and identified issues can trigger additional market controls. Risky products found during inspections may undergo routine market control. Violations are subject to sanctions per relevant regulations on medicinal products and foods for special medical purposes.

Majistral ilaçlar ise Yönetmelik kapsamında değildir. Yönetmelik kapsamında yer alan ürün ve etkin maddeler için belirli periyotlarla piyasa kontrol faaliyeti düzenlenecektir. Piyasa kontrol programına alınacak etkin maddeler ve ürünler, Kurum tarafından belirlenen risk parametrelerine göre saptanacaktır. Belirlenen bu ürünlerin numunelerinin alınacağı yerler İlaç Takip Sistemi verileri uyarınca belirlenecektir.

    Regulation on Inspection of Health Claim Has Been Published

    The Turkish Medicines and Medical Devices Agency has issued the Regulation on Inspection of Health Claim, effective from June 13, 2023. This regulation replaces the Regulation on Health Claims of Products Offered for Sale with Health Claims from 2013 and excludes foods for special medical purposes. Health claims can only be used for food and food supplements, not implying health benefits. Visuals suggesting health claims are prohibited. The product owner and promoter share responsibility for accurate claims and compliance. The Agency can inspect and take actions for violations, including stopping promotions and destroying products.

    Kuzey Kıbrıs Türk Cumhuriyeti’nde Marka Tescil Süreçleri ve Gereklilikleri

    Marka tescili, KKTC ve Türkiye için farklıdır. Türkiye'de tescilli markalar KKTC'de koruma sağlamaz. KKTC'de yalnızca ticari markaların tescili mümkündür ve elektronik sistem yoktur. Her işlem için Mukayyitliğe fiziksel ziyaret gerekir. Uzun onay süreleri işlemleri aylar hatta yıllar sürebilir. Tek bir uzmanın iş yükü artan marka başvurularında gecikmelere yol açabilir. Ancak marka sahipleri, markalarını korumak için KKTC'deki süreçlere önem verir. Yoğunluğa rağmen, fikri mülkiyet adımlarında kolaylaştırıcı değişikliklerin yapılması beklenir.
