These Terms and Conditions (“Terms”) govern your use of the www.turkishlawblog.com website (“Platform”) operated by TLB Teknoloji Medya ve Danışmanlık Limited Şirketi registered in Merkez Mah. Akar Cad. I Tovvers Bomonti Blok No: 3/23 Şişli / İstanbul (“TLB”, “we” or “us”).

Definitions

The following terms shall have the definitions below.

“Platform” means the www.turkishlawblog.com website.

“Contributor” means the lawyers, students, talents, academics or others that create or provide content for the Platform.

“User” means visitors, users and members of the Platform who has access to its content.

Account

Users must register with the Platform to access to the content and enable all the features on the Platform.

Users accept and undertake that (i) they are legally capable of entering into contracts; (ii) they are not prohibited by law from using the Platform; (iii) they will comply with all applicable laws and regulations including intellectual property; (iv) any information they provide us is accurate, up-to-date and complete; and (v) they will update their information upon any changes immediately.

Users are solely responsible for all activities made by their account. Users accept that they will maintain the security of their account and they will not allow third parties to use their account.

TLB may ask for additional information to verify your identity associated with your account to increase the Platform security and to comply with countries' regulations.

Platform Rules

You agree, warrant, represent and acknowledge that you will abide by these Terms, and you will not (i) violate any law, regulation, statute, intellectual property or other third-party right or contract; (ii) use the Platform in any manner that could interfere with, damage, negatively affect, disable, overburden or impair the functioning of the Platform in any way; (iii) jeopardize the security of any account in any way or restrict any other person from using the Platform; (iv) copy, store, reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, distribute or otherwise exploit any portion of the Platform or the content therein; (v) intentionally attempt to harm TLB or Contributors in any way; (vi) extract information about Users or Contributors in order to offer them any services or products.

Intellectual Property

TLB own the intellectual property rights on the Platform. The Platform is protected by the copyright laws of Turkey and other respective countries. All articles and their related content on the Platform are copyrighted works. You must abide by all additional copyright notices or restrictions contained on the Platform.

The Platform and its original content, features and functionality are and will remain the exclusive property of TLB. You agree that you will not reproduce, distribute, duplicate, copy, sell, translate, modify, resell, trade or create derivative works of the content on the Platform for any purpose.

The contents created by Contributors are distributed by themselves via the Platform and Contributors own all the intellectual property rights on their content. Such contents are and will remain the exclusive property of Contributors. Users or Contributors, except for their own content on the site, may not reproduce, distribute, duplicate, copy, sell, translate, modify, resell, trade or create derivative works of the Contributors’ content for any purpose.

You may not use framing or other techniques that make it appear as if TLB is part of another website. You must notify TLB of any potential infringements of intellectual property rights and cooperate with any implementation or information requests made by TLB.

Just as TLB requires Users to respect its copyrights we respect the copyrights of others. If you believe that your copyrighted work has been reproduced on our Platform without authorization in a way that constitutes copyright infringement, you may notify us by email at [email protected]. Any personal data you provide in your email will be used only for purposes related to your email.

Liability & Disclaimer

The content provided on the Site is for informational purposes only and is not intended as legal advice. Turkish Law Blog and the Contributors are not responsible for any actions (or lack thereof) taken as a result of relying on or in any way using information contained in the Platform and in no event they shall be liable for any loss or damages.

The Platform is offered on an “as is” and “as available” basis. In the articles or other available content provided via the Platform, there might be delays, omissions, interruptions and inaccuracies. TLB does not give any guarantee or assurance that the Platform will always be available, accessible, correct, up to date, or meet all the requirements of Users.

Although all care is taken to ensure the integrity, quality and availability of the Platform and the information provided, we do not guarantee that the Service and/or the information contained are complete, accurate. The site and its use are at the User's own risk.

We reserve the right to correct any errors or omissions on the Platform. Descriptions of, or references or access to, other publications within the Turkish Law Blog website do not imply endorsement of those publications.

The views and opinions expressed in all articles are those of the Contributors only and do not necessarily represent the views, official policy or position of the Turkish Law Blog.

You are responsible for complying with all applicable laws and regulations in connection with your use of the Platform including but not limited to Turkish laws and regulations. You accept and agree that in no event shall TLB nor its partners, directors, be liable for any incidental, special, indirect or consequential damages or any damages whatsoever resulting from TLB’s mere negligence.

Privacy

TLB measures Users’ engagement with newsletters, interviews and articles on the Platform and provides statistical feedback to content creators. Content creators may use this data for analytics, market research, learning information about their services, measure the response their content is receiving and other purposes. Once personal data is transferred to content creators, they become a data controller of your personal data and you have the right to obtain information regarding their use of your personal data.

Third Party Content

Our Platform may display, include, or make available third-party content that TLB has no control over. These contents are not controlled by TLB and TLB is not responsible for the content or accuracy of any third-party

The Platform may contain links to third-party websites. These links are provided for your convenience and do not constitute an endorsement of the content on those websites. We are not responsible for the content or accuracy of any third-party websites and do not control their practices.

Term and Termination

These Terms will continue to apply until terminated by either you or TLB. However, you acknowledge and agree that the provisions about Intellectual Property and Liability & Disclaimer are irrevocable and will survive the termination of these Terms.

TLB, at its sole discretion, reserves the right to terminate Users’ access to the Platform for any reason including any violation of these Terms.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Force Majeure

TLB shall not be liable for any failure or delay in the performance of its obligations occurring due to any circumstances arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, accidents, fires, explosions, acts of war or terrorism, civil or military disturbances, strikes, work stoppages, embargoes, epidemic, nuclear or natural catastrophes or acts of god, and interruptions, loss or malfunctions of utilities, power supply, communications, or computer (software and hardware) services.

Governing Law

These Terms and your use of the Platform will be governed by and construed in accordance with the laws of the Republic of Turkey, without giving effect to any principles of conflicts of law. Any disputes arising from or related to the Platform or these Terms will be resolved through the Istanbul Central Courts (İstanbul Çağlayan Mahkemeleri).

Changes

TLB reserves the right to revise, amend or otherwise change these Terms, the content and services provided on the Platform at any time.

The Platform is currently free to all Users and has a “free to view” model. We reserve the right at any time to alter these Terms or to change any features of the Platform.

Should we implement a charged model or make changes to these Terms, we will require your consent, you shall be notified and said terms shall only be applied following your consent. If you do not accept the amended terms, we reserve the right to terminate your account and refuse to provide you with access to the Platform.
