2025 Brings Steep Penalties for Advertising Breaches: Fines Across Media Platforms
The Communiqué (“Communiqué”) on Administrative Fines Applicable in 2025 Pursuant to Article 77 of the Consumer Protection Law No. 6502 (“Law”) was published in the Official Gazette dated December 20, 2024.
Under the Communiqué, the Advertising Board may impose administrative fines ranging from 86,358 TL to 31,808,530 TL for commercial advertisements and unfair commercial practices in 2025, depending on the medium through which these activities are conducted.
In 2025, the fines will apply as follows:
A- For advertisements conducted via locally broadcasting television channels: 158,323 TL to 1,583,230 TL
B- For advertisements conducted via nationally broadcasting television channels: 3,180,853 TL to 31,808,530 TL
C- For advertisements conducted via periodic publications: Half of the fines specified under items (a) and (b)
Ç- For advertisements conducted via locally or satellite-broadcasting radio channels: 86,358 TL to 863,580 TL
D- For advertisements conducted via nationally broadcasting radio channels: 863,580 TL to 8,635,800 TL
E- For advertisements conducted via satellite-broadcasting television channels or the internet: 863,580 TL to 8,635,800 TL
F- For advertisements conducted via text messages: 403,004 TL to 4,030,040 TL
G- For advertisements conducted via other mediums: 86,358 TL to 863,580 TL
When determining the amount of administrative fines within the minimum and maximum thresholds specified, the Advertising Board considers several factors, including the gravity of the violation, the benefit obtained or harm caused, the fault of the violator, and their financial standing.
