Nisa Nildan focuses her practice on dispute resolution, particularly litigation. She assists clients in every level of the national courts and guides them through all aspects of the litigation process, including strategy development, hearings and settlement negotiations. She also assists clients in various aspects of employment law. From August 2015 to February 2016, she was on secondment at Citibank A.S., and from February to July 2018, she was on secondment at FedEx. During her first secondment, she worked on preparing and reviewing board of directors' resolutions; the appointment of a new board of directors; coordinating lawsuit details with outside counsels; and reporting to the bank. During her secondment at FedEx, she assisted the client in various areas of law, including employment law related issues, corporate law, consumer law, and data protection.

The Constitutional Court has annulled the Rule Regarding the Minimum Monetary Limit for Appeal in Administrative Proceedings.

With its decision numbered 2023/81 and dated 26 October 2023 (“Decision“), the Constitutional Court decided to annul the regulations on the lower monetary limit to apply for an appeal in administrative proceedings, due to the lack of clarity in the law as to the date as of which the appeal limit should be considered.

Anayasa Mahkemesi’nden Belirsiz Alacak Davalarına İlişkin Önemli Karar

Anayasa Mahkemesi, 2019/17969 sayılı ve 8 Haziran 2023 tarihli kararında (“Karar“), alacak miktarı belirli olmasına rağmen belirsiz alacak davası açılması durumunda, başvuruculara düzeltme imkanı tanınmadan dava şartı eksikliğinden davanın reddedilmesini mahkemeye erişim hakkının ihlali olduğuna karar verdi. Karar, 6 Ekim 2023 tarihli Resmi Gazete’de yayımlandı.

Important Decision by the Constitutional Court on Lawsuits with Unquantified Claims

With its decision No. 2019/17,969 and dated June 8, 2023 (“Decision“), the Constitutional Court ruled that the court’s dismissal of the lawsuit over lack of procedural prerequisite without giving the applicants the opportunity to correct it, because the applicants filed a quantifiable claim as an unquantified debt, violated the applicants’ right of access to the court.

Yargıtay’dan Önemli Bir İçtihatları Birleştirme Kararı

Yargıtay İçtihatları Birleştirme Büyük Genel Kurulu (“Kurul“), 2021/5 E., 2023/2 K. sayılı kararı  (“Karar“) ile mahkeme kararlarında hatalı olarak gösterilen kanun yolu süresine göre yapılan kanun yolu başvurusunun incelenmesi gerektiğine karar vermiştir. Kararın sonuç kısmı bütün mahkemeler ile adli ve idari organlar üzerinde bağlayıcı olacaktır.

New Decision by the Court of Cassation to Unify the Conflicting Judgments

With its decision numbered 2021/5 E., 2023/2 K. (“Decision“), the Court of Cassation General Assembly on the Unification of Judgements (“Court“) has decided that the application for legal remedy made according to the legal remedy period shown erroneously in the court decisions should be examined. The conclusion of the Decision shall be binding on all courts and judicial and administrative bodies.

Anayasa Mahkemesi (“AYM”), 2022/120 E., 2023/107 K. sayılı kararı (“Karar”) ile, hükmün açıklanmasının geri bırakılması (“HAGB”) kurumunu düzenleyen Ceza Muhakemesi Kanunu’nun (CMK) 231. maddesinin 5 ila 14. fıkralarının iptaline karar vermiştir. Important Annulment Decision by the Constitutional Court

The Constitutional Court's Decision 2022/120 E., 2023/107 K. annuls paragraphs 5-14 of Article 231 of the Criminal Procedure Code, regarding the deferment of verdict announcement. The Decision, effective from August 1, 2024, addresses issues with defendant consent, victim assurance, and lacks clear regulation on confiscation proceedings. New Decision by the Court of Cassation General Assembly to Unify the Conflicting Judgments

The Turkish Court of Cassation General Assembly resolved conflicting opinions with its recent Unification of Judgments Decision, determining that the statement of claim in actions for annulment of objections to execution proceedings must be served on the debtor, not their attorney. This decision provides clarity and is binding for the General Assembly, the Court of Cassation's chambers, and lower courts.
