New Decision by the Constitutional Court on the Annulment of Certain Provisions of the Mediation in Civil Disputes Law No. 6325

Anayasa Mahkemesinden Sendikal Haklara İlişkin Yeni Karar

Anayasa Mahkemesi’nin 2020/11279 numaralı bireysel başvuru kararı, 29 Ağustos 2023 tarihli ve 32294 sayılı Resmi Gazete’de yayımlanmıştır. AYM, çalışanların iş sözleşmelerinin sendikal haklarını korumak amacıyla yaptıkları iş yavaşlatma eylemi sebebiyle feshedilmesinin, sendikal hakların ihlali niteliğinde olduğuna karar vermiştir.

New Decision on Union Rights by the Constitutional Court

The Constitutional Court of Turkey has ruled that the termination of employees' employment agreements due to a work slowdown they initiated to protect their union rights constitutes a violation of their union rights. The Court found that the work slowdown was not disproportionate to the purpose of pursuing union rights and that the employer had a duty to endure it. The Court also ruled that the termination of employment agreements of employees who use their union rights is contrary to the principle of last resort of termination.
