Annual Net Sales Share for Conditional Access Broadcasting
As it is known, with the Law numbered 7491 on the Amendment of Certain Laws and Decree Laws (“Amendment Law”), media service providers providing broadcasting services through conditional access method were obliged to pay a share of one and a half percent (1.5%) of their annual net sales to the Radio and Television Supreme Council (“Supreme Council”) and the Supreme Council was authorized to issue regulations to determine the procedures and principles regarding the payment of net sales.
Accordingly, the Regulation Amending the Regulation on the Provision of Radio, Television and On-Demand Broadcasts via Internet, the Regulation Amending the Regulation on Cable Broadcasting of the Radio and Television Supreme Council and the Regulation Amending the Regulation on Satellite Broadcasting of the Radio and Television Supreme Council (“Amendment Regulations”) entered into force after being published in the Official Gazette dated June 5, 2024 and numbered 32567 in order to regulate the principles and procedures of the relevant obligation introduced by the Amendment Law.
Accordingly, media service providers offering broadcasting services through conditional access are obliged to pay one and a half percent (1.5%) of their annual net sales to the Supreme Council by the end of July of the following year.
In addition, the relevant providers are obliged to submit all kinds of information, documents and records showing their annual net sales within a period of 15 days upon request by the Supreme Council, and if they are unable to fulfill this obligation due to difficulties, they may request an additional period of 15 days, in writing.
