    She specializes in both contentious and non-contentious IP matters, in addition to her impressive work leading major companies through their corporate compliance obligations under Turkish laws. Her expertise spans various sectors, encompassing regulated and non-regulated markets, including but not limited to the life sciences, medical devices, entertainment, and software industries. She also regularly assists corporate clients with contract drafting and negotiations.

    Marka Davalarında Google Ads Şifrelerine Yeni Yaklaşım

    Son dönemde Google, Bing, Yahoo, Yandex, Baidu vb. gibi arama motorları üzerinden verilen çevrimiçi reklamlar, şirketlerin önemli bir tanıtım aracı haline gelmiş durumda[1]. Arama motoru reklamcılığı veya anahtar kelime reklamcılığı olarak bilinen bu reklam türünde, şirketler, arama motorlarının reklam sitelerinde (Google Ads[2], Bing Ads, Yahoo Advertising vb.) oluşturdukları hesap üzerinden giriş yaparak özelleştirilmiş reklamlar veriyorlar. Söz konusu özelleştirme, belirli anahtar kelimeler seçilerek (bkz. anahtar kelime eşleme) yapılıyor[3]. Bu anahtar kelimeler "ayakkabı", "şapka", "spor", "voleybol topu" vb. gibi jenerik kelimeler veya kelime öbekleri olabileceği gibi, farklı markalar ile bağdaşabilecek kelimeler hatta üçüncü kişilere ait tescilli markalar da olabiliyor[4].

    Moral Rights: Is There an Exception for Software?

    The Berne Convention recognizes authors' moral rights, including the right to claim authorship and object to any prejudicial actions. However, the scope of moral rights varies in each country. Turkey, an author-centered jurisdiction, recognizes moral rights for all works, including computer programs. Authors cannot waive moral rights, but they can transfer the authority to exercise them. However, computer programs, considered technical creations, have different implementation in Turkish law. The right to claim authorship is often disregarded in the software industry. Legal scholars and precedents have taken a more flexible approach, considering the collaborative nature of software development. It is crucial to carefully draft copyright license or assignment agreements to address moral rights in the context of computer programs under Turkish law.
