'Domestic Goods Certificate' for Software

The new Domestic Goods Communiqué (Communiqué) prepared by the Turkish Ministry of Industry and Technology (Ministry) was published in the Official Gazette on 25 January 2025.

Under the new Communiqué, software products, along with other products provided in the Communiqué, are now included within the scope of domestic goods. Products that meet the requirements in the Communiqué will be eligible for the Domestic Goods Certificate.

The holder of the Domestic Goods Certificate is granted various advantages such as incentives, support, and market access.

According to the Communiqué, the following conditions must be met for industrial and software products to be classified as domestic goods:

- The product must be produced by an industrial enterprise holding an Industrial Registration Certificate, and the production must fall within the scope of the production subject listed in the Industrial Registration Certificate.

- The product must be entirely produced in Turkey, or significant stages of the production process, as well as the necessary essential labor and actions, must be performed in Turkey.

- The Domestic Contribution Rate of the product must be at least %51.

- Acquisition of the Technological Product Certificate issued by the Ministry.

The Communiqué outlines the method for calculating the "Domestic Contribution Rate" and has created domestic goods categories based on the classification of this rate into specific thresholds. Additionally, it is stated that for software products, having a Technological Product Certificate will result in a Domestic Contribution Rate of 100%.

Applications for the Domestic Goods Certificate will be made through an online system established by the Union of Chambers and Commodity Exchanges of Turkey or the Turkish Confederation of Tradesmen and Craftsmen.
