Important Reminder to Broadcasters
In the recent examinations conducted by the Radio and Television Supreme Council (“RTUK”), it has been determined that both content and durations of commercial communication broadcasts violate the relevant provisions of the legislation.
Despite bona fide warnings regarding commercial communication broadcasts that constitute violation of the Law on the Establishment of Radio and Television Enterprises and Their Media Services numbered 6112 (the “Law numbered 6112”) being made through both press releases and bilateral discussions, RTUK has made the following determinations:
- Even though the maximum advertising time allowed within a one (1) hour time slot is twelve (12) minutes, some media service providers have exceeded this limit, causing harm to the competitive environment and unfairly disadvantaging counterparts who comply with the rules.
- Broadcasters increase the volume levels during commercial broadcasts and hidden advertisement practice.
- In product placement practices, media service providers have interfered with editorial independence, directly encouraged the leasing or purchase of products and services, and excessively emphasized products.
Following these determinations, RTUK has decided to initiate a stricter control process regarding advertisements and declared that the sanctioning power arising from the Law numbered 6112 will be exercised without hesitation in cases of non-compliance with the fundamental rules.
