    The Impact of Climate Change on the Insurance Industry

    Climate change, that started as a scientific theory and became the the subject of environmental policy and international negotiation refers to the long-term changes in the Earth's climate. Climate change poses some major economic risks due to changing weather patterns, extreme weather events, and rising sea levels. According to the Intergovernmental Panel on Climate Change (IPCC), in addition to mitigation efforts, taking steps to adapt to the effects of climate change is also necessary and can greatly reduce negative impacts.

    Responsibility of the Transferee and the Transferor Employer in the Transfer of Workplace

    Article 2 of the Labor Law No. 4857 defines the terms employee, employer, and workplace. The transfer of the workplace occurs as a result of a legal transaction, which may include a lease agreement. The workplace must maintain its economic unity after the transfer, and the transferor and transferee employers are jointly and severally liable for the employees' rights and obligations. The liability of the transferor employer is limited to two years from the date of transfer, except for severance pay, which is not subject to time limitation. The transferee employer is solely responsible for labor receivables arising from work after the date of transfer.

    İşyeri Devrinde Devralan ve Devreden İşverenin Sorumluluğu

    İşyeri devri durumunda, iş sözleşmeleri bütün hak ve borçları ile birlikte devralana geçer. Ancak devrin hukuken sonuç doğurması için işyerinin ekonomik birliğinin korunması gerekmektedir. İş Kanunu'nun 6. maddesi ile Türk Ticaret Kanunu'nun 178. maddesi arasında farklılıklar vardır, ancak birleşme, bölünme ve tür değiştirme hallerinde Türk Ticaret Kanunu öncelikle uygulanır. İş Kanunu'na göre, devreden işverenin sorumluluğu sınırlıdır ve iki yıllık süreyle sınırlıdır. Kıdem tazminatı hususunda ise devreden işverenin sorumluluğu süre sınırlamasına tabi değildir. İşyerinin devredildiği tarihe kadar doğmuş olan işçilik alacaklarından devreden işveren ile devralan işveren müştereken müteselsilen sorumludur, ancak devreden işverenin sorumluluğu devir tarihinden itibaren iki yıllık süreyle sınırlıdır. Devir tarihinden sonraki işçilik alacaklarından ise devralan işveren tek başına sorumlu olacaktır.
